What to do after an accident in Great Neck

  1. Get medical care right away. North Shore University Hospital in Manhasset and Long Island Jewish Medical Center in New Hyde Park are the closest major hospitals. A delay in treatment is one of the first things an insurer will point to.
  2. Report it. Call 911 for a crash. For a fall in a store or building, ask the manager to write up an incident report and get a copy.
  3. Document everything. Photos of the scene, the hazard, the vehicles and your injuries. Names and phone numbers of witnesses.
  4. Give no-fault notice for car accidents. New York’s no-fault rules generally require written notice to the insurer within 30 days of the accident.
  5. Don’t give a recorded statement to the other side’s insurance company before you’ve talked to a lawyer.
  6. Stay off social media about the accident and your injuries.

Deadlines that matter on Long Island

Claims against a public body move fast. If your injury involves Nassau County, the Town of North Hempstead, one of the Great Neck villages, a public school district, or the LIRR, you generally must file a notice of claim within 90 days. The lawsuit itself generally must be started within one year and 90 days.

Most other injury claims must be filed within three years. Medical malpractice has a shorter deadline, generally two and a half years. Waiting can also mean losing video footage and witnesses, so call early.

Sidewalk and road defects work differently on Long Island than in the city. Towns and villages often can’t be held responsible for a defect unless they had prior written notice of it. Who is responsible depends on exactly where you fell, which is why photos of the spot matter.

How fault affects your case

New York uses pure comparative fault. If you were partly responsible for an accident, you can still recover; your compensation is reduced by your share of the fault. An insurance company blaming you is not the end of your case.

Car accident cases also have a threshold: to recover for pain and suffering beyond no-fault benefits, New York law generally requires a “serious injury,” such as a fracture or a significant limitation of a body function. We gather the medical proof that question turns on.

Where Great Neck cases are heard

Injury lawsuits arising in Great Neck are generally filed in the Supreme Court of the State of New York, Nassau County, at 100 Supreme Court Drive in Mineola. Depending on the parties, a case may also belong in a New York City county or in federal court; we file where your case is strongest.

Communities we serve on the peninsula

Great Neck, Great Neck Plaza, Great Neck Estates, Kings Point, Kensington, Lake Success, Russell Gardens, Saddle Rock, Thomaston, University Gardens and nearby Manhasset, Port Washington and New Hyde Park, as well as the rest of Nassau County and all five boroughs.

Frequently asked questions

Do I have to come to Manhattan to meet with you? No. We can meet by phone or video, and much of a case can be handled without coming to the office.

How much does it cost to hire you? Injury cases are handled on a contingency fee. You pay no fee unless we recover money for you. Ask us how case expenses are handled.

I was hurt on the LIRR or at the station. Is that different? Possibly. Claims involving a public authority usually require a notice of claim within 90 days, so don’t wait.

The insurance company already called me. What should I say? You can take their contact information and tell them your lawyer will be in touch. You don’t have to give a recorded statement.

How long will my case take? It depends on your injuries, the insurance involved and whether the case settles or goes to trial. We’ll give you a realistic picture after reviewing the facts.
